Members own and control their co-op and this is the essential characteristic of SouthEast. The board represents the members best through its obligation to be representative, accountable and transparent.

The main difference between the now available 2011 Lease and the previous Reviewable lease, is that the Period of the lease i.e Clause 3 of the lease, is now giving tenants 2 options, Option (a) Fixed Term Renewable Lease, and Option (b) Periodic Lease.Option (a) Fixed Term Renewable Lease, ...says ...

‘ The period of this agreement shall be 5 years minus 1 day commencing

on ..........................................................................

If at the expiration of this agreement, neither party terminates the agreement in accordance with the provisions of the Residential Tenancies Act ( 1997 ) the tenant may exercise the option to renew this agreement for a period of 5 years minus 1 day.’  

 Option (b) Periodic Lease, ...says ...

‘ The agreement will commence on .......................................................... and continue until terminated in accordance with the Residential Tenancies Act.’

 Previously, you were probably offered or given a Reviewable lease, which had a clause in it which stated that if your eligibility criteria changed, e.g...if children left home or your family circumstances altered, then you were required to notify SEHC in writing within one month of becoming aware of any such changed circumstances, and that SEHC on receiving such notice that ..’the tenant is no longer eligible for premises of a particular size, may offer alternative premises to the tenant, but is not obliged to do so.’

That Reviewable aspect of the 2010 lease is no longer in the new 2011 lease, only the two options (a) or (b), as outlined above, i.e (a) 5yearly renewable, or (b) periodic. My clear preference is to take up option (a) 5 yearly renewable, so I would recommend that option to you, but it is your choice. I believe that your security of tenure with the Co-op is not in any danger, but I feel that the 5 yearly Renewable option gives the strongest security of tenure.
